Deep in disarray: On the larger message from the Legislative Assembly of Manipur not being convened
Failure to hold (पकड़ना) Assembly session shows depth (गहराई, तीव्रता) of crisis in Manipur
That the Legislative Assembly (विधान सभा) of Manipur was not convened (hold, assemble, meet, gather) on Monday, as recommended by the Council of Ministers (मंत्रिपरिषद), is an indication of how grave (crucial/critical, important/significant, serious) the crisis gripping (affect, afflict, beset, torment) the State is. Governor Anusuiya Uikey did not issue the notification summoning (order someone to be present; call for, ask for, request the presence of) the House, even though the Cabinet had advised her on August 4 itself to call for (require, publicly ask/necessitate, demand) the session on August 21. The delay on the part of Raj Bhavan in issuing the notification is presumably (सम्भवतः) due to the political and law and order (कानून एवं व्यवस्था) situation in the State. Legislators (विधायक) of Kuki ethnicity (जातीयता, मानवजाति), across party affiliations (संबद्धता), have expressed their inability to attend the Assembly session due to the prevailing (existing, current, present) atmosphere (situation, condition, background, context, scenario), as violence continues in parts of the State. It is unlikely (संभावना नहीं, संदिग्ध) that the Governor is unaware of the constitutional position that she is bound by (constrained by, answerable to, liable to, accountable to, under the control of) the advice of the government with regard to (के संबंध में) summoning the Assembly. A Constitution Bench (संविधान पीठ) had made this clear in Nabam Rebia (2016). Whether the Governor is guided by her own wisdom (बुद्धिमत्ता) or the Union government’s assessment of the situation, it is difficult to justify the failure to hold the Assembly session as sought by the Council of Ministers. The last session of the Manipur Assembly was held in March, and the House has to meet again before the expiry of six months from its previous sitting. The period ends on September 2.
There have been both political and civil society (नागरिक समाज) demands for the Assembly to meet and discuss the violence that broke out early in May over a High Court order that directed the Manipur government to respond to a communication (message, information, statement, report, communiqué) from the Union Ministry for Tribal Affairs on recommending the grant (allocation, allotment, award, allowance) of Scheduled Tribe status to the Meitei community. The delay on the Governor’s part in notifying the session casts a shadow on the legitimacy (वैधता, संवैधानिकता) and authority (authorization, right, power) of the government headed by Chief Minister N. Biren Singh. The Governor would be well-advised (wise, sensible, prudent, thoughtful) to act on (comply with, obey, follow, conform to, abide by, adhere to, uphold) the Cabinet’s recommendation. On another issue, there appears to be an unusual delay in the appointment of Justice Siddharth Mridul, a judge of the Delhi High Court, as the Manipur High Court’s Chief Justice. The court has been under an Acting (temporary, short term, provisional, transitional, interim, stand-in, caretaker) Chief Justice for several months now. Reports suggest that the Centre has forwarded the Collegium’s (The collegium system is the one in which the Chief Justice of India and a forum of four senior most judges of the Supreme Court recommend appointments & transfers of judges. There is no mention of the collegium in the Constitution of India) recommendation to the State government for its consent (approval, acceptance, agreement, assent, concurrence). The question arises whether any constitutional functionary (official, office-bearer, office-holder, administrator) in the State is holding back the process. The chain of events set off (cause, bring about, bring on, lead to, give rise to, prompt) by an order passed by the Acting Chief Justice has already witnessed much violence and disorder, and the State should not lapse (deteriorate, decline, fall, get worse, worsen, degenerate) into further constitutional disarray.
