​For a fair probe: On the Kejriwal bail order and CBI conduct

Kejriwal bail order is a reminder to CBI to dispel (दूर करना, समाप्त करना) perception (धारणा, समझ) of bias (पक्षपाती)

A two-member Bench (a court of law with a number of judges) of the Supreme Court that granted bail (जमानत) to Delhi Chief Minister Arvind Kejriwal in the Delhi excise policy case was divided on the legality (वैधता) of his arrest by the CBI on corruption charges (आरोप) soon after (तुरंत बाद) he was given regular bail in connection with money-laundering charges. After the benefit was given to the co-accused, including Delhi’s Deputy Chief Minister Manish Sisodia and Bharat Rashtra Samithi leader K. Kavitha, under the more stringent (कठोर) Prevention of Money Laundering (धन शोधन) Act, it was only a matter of time before Mr. Kejriwal was also released on conditional bail (शर्तीय जमानत). Justice Surya Kant and Justice Ujjal Bhuyan were one in holding ((of a court/judge) rule, decide) that he was entitled (allow, permit, qualify) to bail and that there was no need, as the CBI wanted, to send him back to the trial court (निचली अदालत). However, while Justice Kant found no violation (उल्लंघन) of procedure in his arrest, as the CBI had approached the trial court for permission to question Mr. Kejriwal and, later on, to arrest him, Justice Bhuyan bluntly (स्पष्ट रूप से) observed (comment, remark, say, mention, state) that the timing of his arrest was “suspect (संदिग्ध व्यक्ति)”. Noting that the CBI did not feel the need to arrest him for 22 months, he questioned the urgency to arrest him “when he was on the cusp of (a (turning) point where something will change or transform from one state/condition to another; cusp means a point, (turning) point, verge, brink) release in the ED (Enforcement Directorate) case”. Justice Bhuyan also recalled (remember, recollect, call to mind, think of) precedents (a past action/event/decision that is seen as an example; previous example, previous instance, prior instance, previous case, example) that say the existence of the power to arrest did not necessarily (certainly, surely, definitely, unquestionably, inevitably) mean that there was a need to arrest.

Justice Bhuyan’s observations (remark, comment, statement, pronouncement) also touched upon the CBI’s reputation (good name, image, standing, stature, status, eminence, prestige, honour). Few would disagree with the view that the CBI should strive (try, seek, attempt, make every effort, give one’s all, do one’s utmost, do one’s best) to dispel the notion (opinion, view ,thought, belief, impression, perception, understanding) that it is “a caged parrot”, and that its investigation should not give the impression (perception, apprehension, feeling, thought, belief, idea) that it probes cases and arrests people in a high-handed (iron-fisted, controlling, domineering, overbearing, strong-arm, draconian) and biased (bigoted, partisan, prejudiced, one-sided, discriminatory, preferential, partial, inequitable, unfair/unjust) manner. The judge has rightly emphasised (highlight, underscore, underline, accentuate, point up, call attention to, focus attention on) the right of the accused (the suspected person, the suspect) to remain silent, and decried (criticize, censure, castigate, denounce, condemn, lambast, reprimand, disapprove of, rail against) the propensity (tendency, inclination, predisposition, readiness, disposition) among investigating agencies to cite (refer to, make reference to, mention, point to) “non-cooperation” or “evasive (vague, elusive, indeterminate, non-committal, imprecise, indirect, inexplicit, unclear, puzzling/perplexing) answers” during questioning as a ground (reason, factor, basis, rationale, premise) to keep suspects (the suspected person, the accused) in prison. If the order of bail in the Manish Sisodia case was a reminder to all judges that bail cannot be denied as a matter of punishment, Justice Bhuyan’s separate judgment will be notable (important, significant, marked, obvious, striking, glaring) for its reminder to the CBI about its obligation (responsibility, onus, accountability, commitment, liability) to keep its investigations fair. There is also some subtle (minute, indistinct, delicate, understated, low-key) criticism of the Delhi High Court’s order rejecting bail to Mr. Kejriwal on the ground that he ought to (must, should) approach the trial court first. Both judges noted that the High Court should have considered bail on merits (an essential inherent quality (rights and wrongs only) while evaluating a case (not by external aspects)), if it had not asked the petitioner (a person who is bringing a lawsuit against another person before a court; claimant, litigator, plaintiff) at the threshold (it is an amount, level, or limit of something. Once the threshold is reached, something else happens or changes; lower limit, starting point, point of entry) itself to approach the lower court, with one of them observing that the delay in issuing notice and hearing the matter at length (for a long time, in detail; in depth, extensively) resulted only in prolonging (lengthen, extend, drag out, protract, continue) his incarceration (imprisonment, captivity, custody, arrest, restraint, confinement, internment, detention).
