  • Question 4
    1 / -0
Which part of the Constitution reflects the mind and ideals of the framers?
    Solution
The Preamble embodies the basic philosophy and fundamental values of political, moral and religious —on which the Constitution is based. It contains the grand and noble vision of the Constituent Assembly and reflects the dreams and aspirations of the founding fathers of the Constitution. In the words of Sir Alladi Krishnaswami Iyer, a member of the Constituent Assembly who played a significant role in making the Constitution, ‘The Preamble to our Constitution expresses what we had thought or dreamt so long’.

  • Question 6
    1 / -0
Which of the following is an incorrect statement?
    Solution
The Indian federal system with a strong centre is based on the ‘Canadian model’ and not on the ‘American model’. The ‘Canadian model’ differs fundamentally from the ‘American model’ in so far as it establishes a very strong centre. The Indian federation resembles the Candian federation (i) in its formation (i.e., by way of disintegration); (ii) in its preference to the term ‘Union’ (the Canadian federation is also called a ‘Union’); and (iii) in its centralising tendency (i.e., vesting more powers in the centre vis-a-vis the states). Law on which the Supreme Court function is adopted from the Japanese Constitution.
  • Question 7
    1 / -0
The Indian Constitution establishes a Secular State. It means ______.
    1. the state treats all religions equally.
    2. freedom of faith and worship is allowed to all the people.
    3. educational institutions, without exception, are free to impart religious instruction.
    4. the state makes no discrimination on the basis of religion in matters of employment.
    Solution
The Constitution of India stands for a secular state. Hence, it does not uphold any particular religion as the official religion of the Indian State. The Preamble secures to all citizens of India liberty of belief, faith and worship. Hence, the Indian Constitution embodies the positive concept of secularism, i.e., giving equal respect to all religions or protecting all religions equally. But Article 28 says that no religious instruction shall be provided in any educational institution maintained by the State. So only statement 3 is not correct.
  • Question 8
    1 / -0
Consider the following statements about the Preamble of the Indian Constitution:
    1. The objective resolution proposed by Pt. Nehru ultimately became the Preamble.
    2. It is not justiciable in nature.
    3. It cannot be amended.
    4. It cannot override the specific provisions of the Constitution.
Which of the above statements is/are correct?
    Solution
The Supreme Court, in the historic case of Kesavananda Bharati (1973), held that the Preamble is a part of the Constitution. The Court stated that the opinion tendered by it in the Berubari Union (1960) in this regard was wrong, and held that the Preamble can be amended, subject to the condition that no amendment is done to the ‘basic features’. In other words, the Court held that the basic elements or the fundamental features of the Constitution as contained in the Preamble cannot be altered by an amendment under Article 368.
  • Question 9
    1 / -0
The Preamble of the Indian Constitution adopted on 26th November 1949 did not include the terms:
    1. Socialist
    2. Secular
    3. Integrity
    4. Republic
    Solution
The Preamble to the Indian Constitution has been amended by the 42nd Constitutional Amendment Act (1976), which added three new words socialist, secular and integrity. The original Preamble adopted on 26th November 1949 did not include these terms.
  • Question 10
    1 / -0
Which one of the following statements regarding the Preamble is correct?
    Solution
In the Kesavananda Bharati case (1973), the Supreme Court rejected the earlier opinion and held that Preamble is a part of the Constitution. It observed that the Preamble is of extreme importance and the Constitution should be read and interpreted in the light of the grand and noble vision expressed in the Preamble. In the LIC of India case (1995) also, the Supreme Court again held that the Preamble is an integral part of the Constitution. It has been amended only once, in 1976. It is non-justiciable, that is, its provisions are not enforceable in courts of law.
