A shade of dark: On the Transgender Persons (Protection of Rights) Amendment Bill, 2026

Bulldozing a Bill through Parliament and pushing it into law while ignoring the public outcry (जन-आक्रोश) is verily (वास्तव में, निस्संदेह) a failure of the democratic process. The way the Transgender Persons (Protection of Rights) Amendment Bill, 2026 was rushed through both Houses of Parliament — amid (के बीच, के बीच में) Opposition walkouts and a storm (हंगामा, उथल-पुथल, जबरदस्त विरोध) of protests by the LGBTQIA+ communities — is condemnable (निंदनीय). There was neither a transparent (पारदर्शी) consultative (परामर्शात्मक) process during the drafting (मसौदा तैयार करना, प्रारूप निर्माण) of the Bill nor an informed (जानकार, सूचित) discussion on its various aspects in Parliament. While the Bill was framed (formulate, devise, draft, construct) as an effort to correct past legislative (विधायी) shortcomings (कमी, दोष), there is an apprehension (आशंका, भय, चिंता) among stakeholders (a person or group that has an interest, concern, or investment in an organization or a specific issue; interested party, participant, contributor) that it applied a heteronormative (denoting or relating to a world view that promotes heterosexuality as the normal or preferred sexual orientation; conventional, traditional, strictly binary, conformist) lens (a perspective or way of looking at something; perspective, viewpoint, standpoint, angle) to a law intended to address (tackle, deal with, attend to, confront) complex issues of gender identity (a person’s personal and internal sense of their own gender, which may or may not correspond to the sex assigned at birth; self-identification) and human dignity (the recognition that human beings possess a special value intrinsic to their humanity, deserving of respect; self-respect). The Bill explicitly (clearly, unambiguously, directly, definitively) states: “The purpose was and is not to protect each and every class of persons with various gender identities, self-perceived (self-identified, subjective, personal, internalized) sex/gender identities or gender fluidities...” This stance (position, standpoint, attitude, perspective) has left many within the community uncertain (unsure, doubtful, unpredictable, ambiguous) regarding (in respect of or concerning; concerning, about, with respect to, respecting) their legal standing (locus standi, legal status, legitimacy, jurisdiction). By moving away from broader (more extensive, comprehensive, expansive) definitions, the Bill has altered the legal landscape (the current state or situation regarding laws and regulations in a particular area; legal environment, legal framework, judicial context) established (create, institute, form, found) by previous judicial precedents (model, example, standard, exemplar), such as the NALSA vs Union of India judgment (a landmark 2014 Supreme Court of India ruling that legally recognized transgender individuals as the “third gender,” affirming their fundamental rights and upholding the right to self-perceive their gender identity without requiring medical intervention). True, concerns have been raised about possible misuse (abuse, misapplication, exploitation, mishandling) of allowing self-perceived gender identities for those seeking (to attempt to find or achieve something; attempt, aim, strive, try) to avail (to use, utilize, make use of, employ, benefit from, take advantage of) of public facilities and government benefits earmarked (to designate something for a particular purpose; allocate, reserve, set aside, dedicate) for transgender persons. But, in the attempt to do away with (to put an end to or remove completely; abolish, eliminate, discard, eradicate) the contentious (controversial, debatable, disputed, disputable) issue of self-identification (the attribution of a particular identity or characteristic to oneself by oneself; self-determination, self-recognition, self-perception, personal identity) of gender without certification by a medical board, it shifts the focus toward mandatory (compulsory, obligatory, binding, required) biological markers (objective indicators or characteristics used to identify something; indicators, signs, characteristics, traits) — including chromosomes (a thread-like structure of nucleic acids and protein found in the nucleus of most living cells, carrying genetic information; genetic material/trait, DNA structure, heredity carrier), hormones, and genitalia (the organs of reproduction, especially the external organs; reproductive organs, sexual organs, genitals, private parts) — or specific socio-cultural communities (traditional, socially and culturally recognized groups of transgender or intersex individuals in India with distinct historical identities; traditional gender groups, cultural transgender identities, indigenous trans communities) such as kinner, aravani, hijra or jogta.

Moreover (as a further matter; besides, furthermore, in addition, additionally), it is problematic to conflate (to combine two or more separate things, especially pieces of text or ideas, into one; merge, blend, fuse, combine) the distinct (recognizably different in nature from something else of a similar type; clear, discrete, separate, individual) concepts of sex (the biological and physiological characteristics (such as chromosomes, hormones, and anatomy) assigned to an individual at birth; biological sex, anatomical sex, physiological categorization) and gender (the socially constructed roles, behaviours, expressions, and personal identities of individuals, which may differ from the biological sex they were assigned at birth; gender identity, sociocultural role, gender expression, personal identity) as done in the Bill. In effect (in practice or reality; virtually, essentially, practically, effectively), the Bill reduces the psychological and socio-cultural markers of gender to biological characteristics (traits, attributes, features). Only those identifiably (recognizably, noticeably, distinguishably, clearly) within the specified set of socio-cultural communities escape the stipulations (condition, requirement, prerequisite, provision) of the legislation (laws considered collectively, or the process of making or enacting laws; law, statute, act, parliamentary measure). Despite these concerns, the government has maintained that the Act reflects (indicate, display, reveal, show, manifest, exhibit) a “collective conscience”, even as stakeholders suggest (to put forward for consideration; propose, indicate, imply, recommend) that the move (step, action, measure, initiative) limits existing protections instead of expanding them. Effective governance mandates (require, dictate, order, command) engagement (involvement, participation, interaction, collaboration) in consultation with all stakeholders. To address the current protests by members of the LGBTQIA+ communities, the government must return to a collaborative (cooperative, joint, united, interactive) approach and move toward a rights-based (human rights-oriented, equity-focused, justice-driven, entitlement-based) law developed through a transparent consultative process. A new legislative proposal should aim to guarantee the equality of every citizen under the law, incorporate the perspectives (viewpoint, standpoint, outlook, angle) of the LGBTQIA+ communities, and provide legal clarity while ensuring dignity (the state or quality of being worthy of honor or respect; self-respect, pride, nobility, worthiness) for all. Otherwise, the government would appear to have created new problems in solving an old one.
