The Supreme Court has ruled that students who withdrew from colleges between November 5 and November 18, 2024, can still take JEE-Advanced three times. This decision was made after the Joint Admission Board (JAB) suddenly changed the eligibility rules, reducing the number of attempts from three to two within just 13 days. This left many students in a difficult situation.

The case was heard by Justices B.R. Gavai and Augustine George Masih. Senior lawyer K. Parameshwar, who represented the students, argued that the change in rules was unfair. He explained that the JAB’s original notification on November 5 promised students from the 2023, 2024, and 2025 batches three attempts to take JEE-Advanced. Based on this information, many students made important life decisions, like leaving their current colleges.

Sudden Policy Change Creates Problems for Students

Parameshwar emphasized that many students withdrew from their college courses to focus on JEE-Advanced, expecting to have three attempts. However, after the rules changed on November 18, those students were no longer eligible for the three attempts they were promised. He said that once the JAB makes a promise, they should not change it without a clear reason.

Government Defends Two-Attempt Rule

Tushar Mehta, representing the JAB, defended the new rule that limits students to two attempts. He argued that allowing three attempts could cause students to lose focus on their studies if they enrolled in college while also continuing to prepare for JEE-Advanced. The government explained that the new rule would help students focus on their academic courses after two attempts at JEE-Advanced.

Court Recognizes the Students’ Struggles

Justice Gavai acknowledged the problems caused by this sudden change in policy. While he agreed that limiting attempts to two is a reasonable rule, he said that the quick change in just 13 days was unfair to students who had already made decisions based on the original notification. He stated that students who withdrew from colleges should not be harmed by this change in rules.

Court Grants Relief to Affected Students

In its decision, the court allowed students who withdrew from their colleges between November 5 and November 18, 2024, to still register and appear for JEE-Advanced according to the original rules. This means those students can take the exam three times, ensuring they are treated fairly.
