In the way: On the Tribunal Reforms Bill 2026

Tribunals have a raison d’être in the justice system: they allow specialists to settle technical disputes faster than the judiciary (न्यायपालिका, न्यायिक व्यवस्था) could. In S.P. Sampath Kumar (1987) and L. Chandra Kumar (1997), the Supreme Court said that tribunals’ decisions remain subject to (के अधीन, पर निर्भर) review by High Courts because judicial review (न्यायिक समीक्षा) is part of the basic structure. Sensible (समझदारीपूर्ण, तर्कसंगत) though they were, the orders left a structural flaw (दोष, खामी) standing (remaining in force or continuing without being altered; unaddressed, remaining, continuing, lingering). Tribunals have historically (ऐतिहासिक रूप से, अतीत में) been administered (प्रशासित करना, प्रबंधन करना) by the same Ministries whose decisions the tribunal might have to review. In Rojer Mathew (2019) (a significant Indian Supreme Court case that examined the constitutional validity of the rules governing tribunals), the Court recommended an independent (स्वतंत्र, स्वायत्त), statutory (वैधानिक, कानून द्वारा निर्धारित) National Tribunals Commission (NTC) (राष्ट्रीय न्यायाधिकरण आयोग) to oversee (निगरानी करना, देखरेख करना) the selection and administration (प्रशासन, प्रबंधन) of tribunals. However, Parliament used the Finance Act 2017 (an Indian legislation that introduced changes to the structure and functioning of tribunals) to give the executive (कार्यपालिका, कार्यकारी शाखा) more control over appointments and the Tribunals Reforms Ordinance 2021 to reinstate (restore, put back, bring back, reestablish) conditions (stipulations, terms, requirements, provisions) the Court had rejected. The final straw (the last problem, event, or difficulty in a series that makes a situation intolerable or causes someone to take decisive action; breaking point, last straw, culmination, limit) was the Court’s judgment in Madras Bar Association (2025) (a Supreme Court of India case concerning the constitutional validity of provisions relating to tribunals, particularly their composition, independence, appointments and service conditions; the Court reiterated the need to preserve judicial independence and effective adjudication in the tribunal system), where it struck down the objectionable (unacceptable, offensive, inappropriate, undesirable) provisions (conditions or requirements in a legal document; clauses, stipulations, articles, terms) Parliament had re-enacted (to bring a law into effect again; reestablish, restore, reintroduce, resurrect), restored the previous framework (an essential supporting structure of a system; structure, system), and gave the government four months to establish (to set up, found, create, institute, form) the NTC. That is the Tribunal Reforms Bill 2026, which the Lok Sabha (the lower house of India’s bicameral Parliament; House of the People, lower house) passed on August 10 with no discussion (debate, deliberation, dialogue, discourse), and the Rajya Sabha (the upper house of the bicameral Parliament of India; Council of States, upper house) on August 11. To its credit (used to indicate that someone deserves praise for a particular thing; commendably, praiseworthily, admirably, meritoriously), inter alia (among other things; besides, alongside, additionally, among others), the Bill (a formal proposal for a new law or a change to an existing law, introduced before a legislature for consideration and approval; proposed law, legislative proposal, draft legislation) restores the five-year terms for tribunal members, introduces uniform (constant, consistent, unvarying, standardized) service conditions (the terms, rules, and regulations governing an employee’s job; employment terms, working conditions, job stipulations, work rules), includes provisions for a National Tribunals Data Grid (a proposed centralized digital platform to maintain records pertaining to all tribunals in India), and does not maroon (to leave someone trapped and isolated (here, referring to leaving appointments pending); abandon, strand, isolate, forsake) already pending appointments.

However, the Bill still does not give the NTC enough (as much as required or as many as required; sufficient, adequate, ample, abundant) institutional autonomy (the ability of an institution to make decisions and manage its affairs independently, without undue external control or interference; institutional independence). For one (for example; particularly, specifically, notably, predominantly), Section 14 leaves the qualifications, manner of selection, salaries, allowances, and other conditions of service of tribunal members to future executive (relating to or having the power to put plans or actions into effect; administrative, managerial, governing, directing) rules. But in Rojer Mathew, Justice Deepak Gupta had held that defining who is qualified to exercise judicial power (the constitutional authority vested in courts and judges to hear cases; legal authority, adjudicatory power, magisterial authority, court jurisdiction) is an essential legislative (having the power to make laws; lawmaking, parliamentary, statutory, policy-making) function (duty, role, responsibility, task) that cannot be delegated (to entrust a task or responsibility to another person; assign, entrust, transfer, hand over) to rulemaking (the process by which executive agencies create regulations; legislating, regulation-making, lawmaking, policy-setting). Yet, the Bill claims (to state or assert that something is the case; assert, state, profess, maintain) consonance (agreement or compatibility between opinions or actions; agreement, harmony, accord, compatibility) with the 2025 judgment while making room for the sort of (to some extent or in some way; somewhat, rather, moderately, slightly) delegation (the act of giving control or authority to another person; transfer, assignment, handing over, deputation) the judge’s line of reasoning (a set of reasons used in order to reach a conclusion; argument, rationale, logic, train of thought) had resisted. Experts have also flagged (to draw attention to something; highlight, indicate, point out, identify) similarly vague (of uncertain, indefinite, or unclear character or meaning; ambiguous, unclear, indistinct, imprecise) language (the phraseology used in a legal document; wording, phrasing, terminology, text) in Section 3. Further, under Section 16, a Ministry will first screen (to evaluate or investigate someone or something; vet, evaluate, assess, examine) a complaint before it passes to the NTC for inquiry (an official investigation; investigation, probe, examination, review). So, while the process is more elaborate (complex, detailed, intricate, complicated) than it was in 2021, the Centre still appoints the NTC’s members, only consulting the CJI for the chairperson (a person chosen to preside over a meeting or a committee; chair, president, head, leader) and judicial members, and retains substantial (significant, considerable, material, major) influence (sway, power, control, leverage) over its finances and administration. That is essentially (fundamentally, primarily, basically, principally) a continuing failure: (breakdown, collapse, shortcoming, defeat) a commission (committee, board, panel, council) designed to insulate (to protect from the negative effects of something; protect, shield, safeguard, separate) tribunals from executive control (the authority and power exercised by the administrative branch of government; administrative oversight, government dominance, executive influence, state authority) cannot be thus subject to the terms of the executive. The government must make the NTC fully independent (completely free from outside control or influence; entirely autonomous, completely self-governing, wholly impartial, absolutely free) by forsaking (to abandon or give up something; abandon, relinquish, renounce, surrender) its power to appoint or remove its members at will.
