This is the latest in a series of interventions (involvement, intercession, mediation, interference) by the Court this year, cautioning against the use of AI-generated fictitious judicial precedents in court proceedings (legal action, lawsuit, hearing, trial). Through its rulings (verdict, decision, judgement, decree) and oral (spoken, verbal, unwritten, vocal) observations, the Court has consistently (always, regularly, invariably, constantly) adopted (embrace, take on, accept, implement) a strict (stringent, rigorous, firm, uncompromising) and cautionary (warning, preventive, deterrent, premonitory) approach to the deployment (the action of bringing resources into effective action; utilization, implementation, application, execution) of AI in the justice delivery system. On February 27, the same Bench of Justices P.S. Narasimha and Alok Aradhe took cognisance of a trial court (a court of law where cases are tried in the first place; lower court, primary court, judicial body, hearing court) relying on AI-generated fictitious case laws and underlined that it was not merely “an error in decision-making” but amounted to judicial “misconduct”.
The Court has made clear that AI may serve as (function as, act as, work as, operate as) an assistive (helpful, supportive, aiding, auxiliary) tool to improve efficiency, but it can never replace independent (free from external control, influence, or dependence; autonomous, unbiased, impartial, self-governing) human reasoning (critical thinking, logic, rationale, intellect), judicial discretion (choice, judgment, option, volition) or professional accountability (responsibility, liability, answerability, culpability).
