According to reports on Monday, the Centre informed the apex court about the CBSE's newly introduced policy to assess the students studying in private schools. The affected students include those who lost out on their board exams in Gulf countries amid the Iran-US war.

The issue was taken up by a Bench of Justices S V N Bhatti and Vipul M Pancholi. Solicitor General Tushar Mehta, appearing for the Centre and the CBSE, informed that an all-India policy has been notified.

This is meant to take into consideration the grievances of students whose exams have been cancelled in the Gulf due to regional tensions.

According to the Solicitor General, the new policy was notified on June 21. This includes a specific formula to assess private students appearing for board exam.

Mehta explained the details of the policy. In cases where the board exam could not be conducted for certain subjects, then a student's performance will be assessed based on the marks obtained in Class 10 and the last-attempted Class 12 board exam.

For such cancelled subjects, the marks will be arrived at based on 40 per cent of the theory marks obtained in Class 10 and 60 per cent of the theory marks in last-attempted Class 12 board exam.

Mehta pointed out that two categories of students are most impacted by cancellation of board exams in seven Gulf countries. These include regular school students and private candidates.

In particular, the Solicitor General highlighted the challenge posed before private candidates. They don't have a school which can provide the records of their internal assessment, which includes quarterly, half-yearly, and pre-board exams' marks.

These marks are the very basis of the March 27 scheme of assessment.

The top court was hearing a petition filed by Pransu Jigarkumar Patel. He is a private candidate studying in Al Jubail, Saudi Arabia. He is challenging CBSE's failure to declare his Class 12 improvement exam results.

According to the petitioner, the March 27 scheme covered regular students and nothing has been done for private candidates appearing for improvement exams. Due to this, the results have been withheld as "Result Later" (R.L.).

According to him, the non-declaration of the results is arbitrary and discriminatory.

Moreover, the failure to declare results adversely affects his higher education opportunities.

The petitioner stated that in his case, Physics and Chemistry exams were held whereas Math, English and Computer Science papers were cancelled.

In this case, the petitioner was evaluated on the actual marks of Physics and Chemistry which are the two papers appeared for by him. The marks of the three cancelled subjects were worked out on the basis of the newly notified formula on June 21.

Mehta informed the bench that according to the newly introduced policy, the marks of the petitioner were better than his previous performance. The results have been sent to him by email as well as will be updated in his DigiLocker.

Moreover, according to Mehta, the new policy allows students to have another choice. If the student is unhappy with the assessed marks, then he can appear in the next board exam.

When the bench asked the petitioner's counsel if his grievance has been sorted after CBSE announcing the new policy, Advocate Vineet Jindal, appearing for the petitioner, confirmed that his results have been declared. However, he requested the court to ensure his right to seek copies of his answer script and get his answers reviewed as per CBSE guidelines.

The Bench checked the writ petition and found that it does not make such request. The bench clarified that court cannot pass any order beyond the reliefs sought.

The bench took note of Solicitor General's submissions and disposed of the petition. Moreover, it left the petitioner liberty to seek legal remedy if he has any grievance.

CBSE cancelled Class 12 board exams in seven West Asian countries including Bahrain, Iran, Kuwait, Oman, Qatar, Saudi Arabia, and UAE.
