CBSE Class 12 Results: Supreme Court to Hear Plea on Assessment Formula for Gulf Students
"The Supreme Court will next week hear a petition challenging the scheme of assessment for regular class 12 students who were affected due to cancellation of board examinations in Gulf countries owing to the Iran-US war," read a statement from the apex court on Tuesday.
Solicitor General Tushar Mehta representing the CBSE informed a Bench comprising Justices M M Sundresh and P B Varale that the Board will file their response in the matter.
On July 8, the Bench agreed to hear the petition which has been filed by 30 regular students studying in Gulf countries, and sought responses from the Centre and the Central Board of Secondary Education (CBSE).
Issuing notice while asking for a copy of the plea to be placed before the Solicitor General, the Bench has also sought responses on another petition filed by a class 12 student from Gulf countries which challenges the notification dated June 21 regarding examination of private candidates.
The counsel for petitioners has argued before the Bench that the students are not satisfied with the scheme of assessment.
The plea filed by 30 regular students has prayed the apex court to quash or modify the scheme of assessment dated March 27, 2026 and also to adopt a proper, just and transparent assessment process.
In addition to this, the students have sought direction to conduct a special fresh examination and improvement examination in all subjects.
They have demanded to conduct such examinations without putting any ceiling on the number of subjects to be appeared and to retain whichever results is beneficial to the student.
What the CBSE Told the Court
On June 22, the Centre told the court that CBSE had prepared an entirely new policy for private candidates affected by the cancellation of the exam. According to Mehta, this was a new policy applicable throughout the country for all those students who faced this problem due to cancellation of the exam in the Gulf region due to regional conflict.
According to this policy announced on June 21, a new formula is available for the private candidates. The marks in the subjects in which there could not be any exam will be calculated based on the Class 10 score and previous Class 12 board examination attempt.

As per Mehta, the two categories of students most badly hit in all seven Gulf countries included those pursuing their education at regular schools and private candidates.
Private candidates formed a special category for concern as they have no schooling institution to provide internal assessment papers – quarterly, half yearly and pre-board scores. These scores were the very basis of computation of grades under the original March 27 scheme.
The plea was being heard by the court in another separate petition. The petitioner was a private candidate from Al Jubail of Saudi Arabia and he complained of failure on the part of CBSE to announce his class 12 improvement examination score under the original scheme.
CBSE had cancelled class 12 board examinations in seven West Asian countries including Bahrain, Iran, Kuwait, Oman, Qatar, Saudi Arabia and UAE due to warlike situation prevailing in the region.
