Deemed ineligible: On the Supreme Court and SIR

Deemed ineligible: On the Supreme Court and SIR

Deemed ineligible: On the Supreme Court and SIR

The Supreme Court has pointed to (संकेत करना, इशारा करना) the SIR’s flaws (दोष, खामी) by design

At Wednesday’s hearing (सुनवाई) of a petition (याचिका) on the Delhi SIR in the Supreme Court, Justice Joymalya Bagchi asked questions that cut to the heart (address the most important or essential part of an issue; get to the core, go to the root, hit the mark, focus on the essence, strike at the crux) of the Election Commission of India (ECI)’s (भारत निर्वाचन आयोग) SIR of electoral rolls (मतदाता सूची). If an existing (मौजूदा, वर्तमान) voter was “lax, inert (निष्क्रिय, जड़) or did not respond” to enumeration forms (a form used during the Special Intensive Revision (SIR) of electoral rolls to collect and verify voters’ details for updating the electoral register; voter-verification form, electoral-roll verification form, voter-information form), was that a ground (आधार, कारण) for the ECI to “forfeit (lose or be deprived of a right, privilege, or possession as a consequence of an action or failure to meet a requirement; surrender, relinquish, sacrifice, yield, give up) his or her right to vote (मतदान का अधिकार) forever (हमेशा के लिए, सदा के )”? The Bench (न्यायपीठ) headed (lead or be in charge of, direct, preside over, command) by the Chief Justice of India Surya Kant said that the ECI was in “error” to force such voters, struck off for not returning enumeration forms, to reapply on Form 6 (An official application form provided by the Election Commission of India used for the registration of new voters or inclusion of names in the electoral roll) as if (as would be the case if; as though, supposedly, ostensibly, seemingly) they were new voters. It asked why voters who had shifted residences could not just disclose (reveal, divulge, unveil, uncover) details and why deleted voters could not fill enumeration forms belatedly (happening or arriving after the expected or usual time; late, tardily, delayed, overdue). This is the central design flaw (core defect, fundamental weakness, primary fault, structural error) of the SIR as it shifts (change, transfer, redirect) the burden (a heavy load or a difficult responsibility; responsibility, load, weight, strain) of enrolment from the state (government, regime, administration) to the elector (voter, constituent, enfranchised citizen), including those who have voted before, and treats a mere change of address (relocation, transfer of residence, address update) as ground for deletion. The share of draft (denoting a preliminary version of a document or plan; preliminary, provisional, unfinalized, rough) deletions recorded as “shifted (moved to a different place or residence; relocated, moved, transferred, displaced)” or “absent (missing, away, gone, unavailable)” rose from 55% in Bihar to 72% in States/Union Territories in Phase 3. In Karnataka, about 84 lakh electors were deleted, marked (indicate, label, designate, categorize, identify) as “shifted” or “absent” during enumeration. But only a net (final amount, total, result, aggregate) of 8.2 lakh, including new electors, were added during the claims (a formal request or demand for something; petition, application) phase, with the final roll being 64.5 lakh short of (less than the required or expected amount; lacking, deficient in, missing, inadequate) the projected (estimated, forecast, predicted, anticipated) adult population. Requiring moved voters to re-register as fresh applicants defeats (prevent the success of something; thwart, frustrate, foil, ruin) the ECI’s historic mandate (a highly significant or traditionally established authoritative instruction or command; traditional authority, landmark directive, enduring mission, time-honored directive) of widening the franchise (the right to vote in public elections; suffrage, voting right, enfranchisement, ballot right), which was inherent (intrinsic, innate, inbuilt, essential) in the 2002-03 intensive revision (a process of revising electoral rolls through house-to-house visits and verification by election officials to prepare an accurate draft electoral roll; house-to-house revision, thorough revision), where enumerators (an official assigned to conduct house-to-house visits to collect and verify household and voter details for preparing or revising electoral rolls; surveyor, data collector, field investigator) enrolled shifted voters at their new homes and the Chief Electoral Officer (a statutory officer designated or nominated by the Election Commission of India, in consultation with the State Government, under Section 13A of the Representation of the People Act, 1950, to supervise the preparation, revision and correction of electoral rolls and the conduct of elections in the State, subject to the superintendence, direction and control of the Election Commission of India) reconciled (make one account or record consistent with another; match, harmonize, square, balance) the old entries (previous record, past registration, former listing, prior data).

Justice Bagchi also mentioned that the Bihar judgment was not a “binding precedent (a legal rule or principle established by a higher court that must be followed by lower courts in subsequent similar cases; mandatory authority, authoritative ruling, binding rule, legal standard)” and that the legality (lawfulness, validity, legitimacy, permissibility) of “logical discrepancy (a lack of compatibility or similarity between logical facts or data points; inconsistency, contradiction, mismatch, divergence)” checks (inspection, scrutiny, examination, verification), allowed only as an “interim arrangement (a temporary plan or measure put in place until a permanent solution is found; temporary measure, stopgap, provisional plan, temporary setup)” in West Bengal, had not been finally adjudicated (judge, decide, determine, resolve). No statute (law, act, decree, enactment) or rule provides for judging a voter’s eligibility (qualification, entitlement) on the basis of (because of or using as a foundation; based on, by virtue of, due to, according to) family size or the age gap between voters and parents, which were two of the ECI’s ludicrous (so foolish, unreasonable, or out of place as to be amusing; absurd, ridiculous, laughable, preposterous) and algorithm-driven (controlled, directed, or operated by a set of automated computational rules or processes; automated, computer-programmed, software-based, computational) “logical discrepancy” checks. In West Bengal these checks resulted in (lead to, cause, produce, bring about) massive disenfranchisement (the state of being deprived of a right or privilege, especially the right to vote; deprivation of the vote, exclusion, marginalization, disempowerment) and The Hindu’s analysis found that in Delhi, Muslims were disproportionately (excessively, unevenly, inordinately, unequally) flagged (draw attention to something, especially in order to identify it as a problem; highlight, indicate, mark, point out). But the Court should not merely issue (release, put out, distribute, publish) managerial fixes (an administrative or operational adjustment meant to solve a problem without addressing deeper structural issues; administrative solution, operational adjustment, superficial remedy, procedural tweak) such as extended deadlines (prolonged time limit, delayed cutoff, postponed due date, stretched timeline) or displaying printed lists in blocks, as it has in the past. The final SIR rolls are erroneous (wrong or incorrect; incorrect, wrong, inaccurate, mistaken) as deletions flowed from a flawed (defective, faulty, imperfect, unsound) design rather than (instead of or in place of; instead of, as opposed to, in preference to, over) just lapses (failure, mistake, oversight, error) by the ECI. The dead and duplicate entries that the SIR identified should be removed and newly eligible electors added. Voters wrongly removed from draft rolls (a preliminary version of an electoral list that is published for public review and objections before finalization; preliminary voter list, provisional electoral register) must be included again. The larger questions over the Commission’s SIR conduct (management, administration, handling, operation) and how its members are appointed must also be settled.
