JEE Advanced 2021 which is scheduled to be held on October 3rd, 2021 by the Indian Institutes of Technology, Kharagpur (IIT Kharagpur) may allow 3rd attempt students to write entrance exams if their appeal will be accepted.

On Wednesday, September 15, 2021, the supreme court disposed of a writ petition on the permission for 3rd attempt students and said that these students can make a representation before the authority of the JEE Board, JEE (Advanced). It is so that the board can make a decision for each student.

There was a bench of three Justices namely, AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar who made the decision. The bench asked the JEE board to find the possible solutions to this situation so that in near future the students do not have to file the petition again.

The Petitioner’s Argument

Referring to the criterion 4 of clause 11 in the JEE Advanced 2021 Information Brochure, the petitioners stated that any students who have finished their high school in 2019 will be declared ineligible to write the JEE Advanced 2021 exam. 

But the petitioner pointed to the fact that even though the students finished school in 2019, they still fall under the age limit set by the JEE board to appear for the JEE Advanced exam. They also said that this clause is violating Article 14 of the Indian Constitution, which clearly says that every citizen is equal before the law and must get equal opportunities. 

Furthermore, the petitioners suggested that their attempt to give the JEE Advanced 2020 should not be considered valid as the situations were very different due to the global pandemic-related issues. 

The bench said that they cannot change the rule of the JEE Board but has asked the authorities to carefully evaluate each applicant and make a fair decision for each student.

The petitioners are those who have cleared their JEE Mains 2021 examination carefully.
