NEET UG 2024: SC Declines Stay on Re-test or Counselling Postponement

The Supreme Court declined to halt the proposed re-test by the National Testing Agency (NTA) for 1,563 candidates who took the NEET-UG 2024 exam or postpone the medical college admissions counselling scheduled to begin on July 6.
A vacation bench comprising Justices Vikram Nath and S V Bhatti, set to hear various NEET-related petitions on July 8 after the summer recess, dismissed the request. They suggested waiting for the final decision as overturning the main May 5 exam could potentially affect all candidates.
Justice Nath remarked, "Nothing will change now. If the May 5 exam might be set aside, why discuss the re-test for 1,563 candidates?"
The petitioner's counsel sought a stay on the re-test, alleging NTA withheld key information: 753 of these candidates had previously failed. He argued this gave them an unfair advantage over qualified candidates wanting to retake the exam, causing unnecessary stress.
Justice Nath questioned the concern, asking, "Are you worried about these candidates or those not getting a chance to retake?"
Another petition requested a two-day pause in counselling, which Justice Bhatti denied, stating counselling is a flexible process starting on July 6, allowing applicants time to consider their options before finalizing.
Addressing a candidate unable to write due to a rare medical condition, the court instructed NTA to decide on his request for a re-test promptly.
Overall, the court emphasized fairness and transparency in handling these issues, ensuring all candidates have equitable opportunities in the admission process.
